Sam Bankman-Fried, the disgraced founder of FTX, was found guilty of breaking his bail terms on August 11, and the judge ordered that he be held in the Brooklyn Metropolitan Detention Centre (MDC). However, SBF requests a release under exceptional circumstances precisely one week later.
SBF Asking For Weekday Bail
SBF's attorneys request in a letter dated August 18 that SBF be released during the weekdays so they can effectively prepare for his defense. The letter is addressed to US District Judge Lewis Kaplan. The attorneys rejected the initial strategy proposed by the prosecutors for how SBF would get ready for his trial, which starts on October 2.
According to reports, federal prosecutors assigned SBF two days a week to work on his caseload without providing him with the necessary resources. According to the legal counsel for SBF, this preparation time needs to be more extensive and infringes on his sixth amendment rights.
This needs to be improved, and Mr. Bankman-Fried will not be able to actively participate in his defense as is his constitutional right.
Christian Everdell, who is in charge of SBF's legal team, makes the case that their client has to be released so that he can thoroughly examine the evidence that federal prosecutors have presented against him. They said he had no time or resources to accomplish this from his prison cell.
Everdell said that Prosecutors sent "three-quarters of a million pages of Slack communication" last week to emphasize the volume of papers SBF must review. He mentioned how difficult it would be to review such documents right now.
If approved, SBF will have access to an internet-enabled laptop to peruse his case files and prepare his defense while meeting with his attorneys during the week at the federal courthouse. According to his attorneys, this will quicken the procedure and guarantee they are well-equipped for his fraud trial.
